1. ACCEPTANCE

4. GENERAL PROHIBITION
   By accessing and using pornoflix, the User agrees NOT to:

(a) infringe intellectual property rights and privacy, including but not limited to copyright, database rights, trademarks or third party know-how;

(b) download, send, transmit or store material that:
is unlawful, offensive, defamatory, fraudulent, deceptive, misleading, harmful, threatening, hostile, obscene, or objectionable;
disrupts or interferes with normal pornoflix applications, such as sending or transmitting viruses, worms or Trojan horses, continuously sending repeated material or sending unusually large files; or
that is not permitted by pornoflix, such as unauthorized advertising material, unsolicited promotional material, “junk mail,” “spams,” “chain letters,” pyramid selling messages, franchises, distribution material, club membership, Terms of Use, or any other unacceptable material such as pornography of any kind involving minors, animals, or excessive harassment of any living thing;

(f) access or attempt to access the account or login of any User through hacking techniques of penetration or social engineering in pornoflix;

(g) copy, modify, reproduce, delete, distribute, download, store, transmit, sell, resell, publish, reverse engineer, or create derivative products from the Content, except as to the material submitted by the User and owned by the User, or as authorized by applicable intellectual property laws;

(h) impersonate another person;

(i) use pornoflix in an unauthorized manner or for any criminal activity;

(j) falsify header information in email or spoofing;

(k) misrepresent information about yourself, your association with third parties, or your business.

5. USE OF THE SITE AND SPECIFIC OBLIGATIONS
   In addition to the general obligations set forth in Article 5, the User shall:(a) use pornoflix only for the legally permitted purposes of audiovisual entertainment;

   (b) provide and maintain the personal data that make up the User Information in a complete, correct, updated and truthful manner;

6. DISCLAIMER

ALSO DISCLAIMS ANY LEGAL IMPLICATION OF THE CONTENT TRANSMITTED AS STREAMING ON THIS PLATFORM, WHICH WAS OBTAINED BY LEGAL MEANS FROM THIRD PARTIES, ACCORDING TO ITS TERMS OF USE, USING AN AUTOMATIC ALGORITHM OF “MACHINE LEARNING”, WHICH BY ITS CHARACTERISTICS CAN NOT BE SUBJECT TO ANY LEGAL ACTION IN ANY COUNTRY IN THE WORLD, TO DATE.

   11. LIABILITY AND LIMITATION OF LIABILITY
   USER AGREES TO ASSUME ALL RISKS ASSOCIATED WITH, OR DERIVED FROM, THE USE pornoflix OR INFORMATION PROVIDED BY USER, INCLUDING, BUT NOT LIMITED TO, THE RISKS OF ECONOMIC LOSS, DAMAGES TO PROPERTY AND NEGOTIATION EXPENSES WITH OTHER pornoflix (WHETHER UNKNOWN, MINORS, FOREIGNERS OR PEOPLE ACTING UNDER FALSE IDENTITY). THE USER ALSO UNDERTAKES TO EXONERATE IO MEDIA S.A.S. FROM ALL LIABILITY, THE PARENT COMPANY AND ITS SUBSIDIARIES AND AFFILIATES, AS WELL AS THE DIRECTORS, MANAGERS, SALESMEN AND EMPLOYEES OF ALL OF THEM, AGAINST CLAIMS, CLAIMS OR CLAIMS OF INDEMNIFICATION FOR DAMAGES AND DAMAGES (DIRECT, INDIRECT AND SURROUND) OF ANY KIND, KNOWN OR NOT, WHICH MAY BE INTERPOSED ON AN BASIS OR WHICH ARISE FROM THE USE pornoflix, USER FACILITATED INFORMATION OR TRANSACTIONS ARISING OUT OF USER’S pornoflix USE.

   ALWAYS WITHIN THE LEGAL LIMITS, THE USER ASSUMES AND ACCEPTS THAT IN NO CASE, NOR IO MEDIA S.A.S. NOR ITS PARENT COMPANY, ITS SUBSIDIARIES AND AFFILIATES, NOR ITS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES OR SUPPLIERS OF ALL OF THEM, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE (INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE AND PURE ECONOMIC DAMAGE), NOR FOR LOSS OF PROFIT, LOSS OF CUSTOMER BASE, LOSS OF REVENUE OR DATA OR INTERRUPTION OF USE, REGARDLESS OF THE CAUSE THEREOF – BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR BREACH OF WARRANTY – EVEN WITHOUT LIMITATION.A.S. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. IN THE EVENT THAT ANY JURISDICTION PROHIBITS THE EXCLUSION OF CERTAIN WARRANTIES, THE LIMITATION OF LIABILITY OR THE RELEASE OF LIABILITY FOR CERTAIN DAMAGES, THE AGGREGATE LIABILITY OF IO MEDIA S.A.S. FOR DAMAGES SHALL NOT EXCEED $10.00, IF PERMITTED BY APPLICABLE LAW.

   IN ANY EVENT, THE FOREGOING LIMITATION OF LIABILITY SHALL NOT APPLY TO CONSUMERS OR IN RESPECT OF DAMAGE CAUSED INTENTIONALLY OR BY GROSS NEGLIGENCE.

7. RESCISSION
   IO MEDIA S.A.S. may, at its sole discretion, terminate the services offered on its Website and remove any Content from the Website. IO MEDIA S.A.S. may also, at any time, for any justified or unjustified reason and without having to give prior notice of its decision, suspend the User’s access to any or all of the services offered on pornoflix. In the event that the User decides to cancel their account, they must cease to access and no longer use pornoflix. IO MEDIA S.A.S. shall have no obligation whatsoever to maintain or return the Information provided by the User, its account, its virtual account number and its password. The User must always have a copy of the Information provided by him/her.
   
   13. GENERAL
   The User declares that between him and IO MEDIA S.A.S. there is no relationship of employment contract, association, agency or joint venture, arising from access and use pornoflix.The present Terms of Use integrate all the agreements that the User and IO MEDIA S.A.S. have reached in relation to access and use pornoflix, and is subscribed in addition to any binding agreement that may exist between the User and IO MEDIA S.A.S..

   These Terms of Use shall be governed by and construed in accordance with Chilean law and the User submits to the exclusive jurisdiction of the courts of Santiago.

   If the User consults, accesses, sends information or downloads material from pornoflix from outside Chile, the User will be solely responsible for their actions and assume all risks. You may not use or export the pornoflix Content or make any copy or adaptation that violates any applicable laws, regulations or standards, including but not limited to U.S. export laws and regulations.

   The failure of a party to exercise or delay in exercising its rights and remedies under these Terms of Use at any time shall not be construed as a waiver of such rights and remedies.

   The invalidity or unenforceability of any of these Terms of Use – in whole or in part – or of the rights arising from these Terms of Use shall not affect the validity or enforceability of the other rights, Terms of Use, or the remainder of the provision in question, which shall continue in full force and effect, excluding only the defective clause (or the part invalidating such clause).

   Articles 10, 11, 9, 2, 3 of these Terms of Use shall survive termination for any reason.
